These Terms of Use ("Terms") govern your access to and use of the Pocus diary application ("the App," "Pocus," or "Pocus Diary") developed and operated by Kivrak Business LLC, a Wyoming limited liability company ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

You must be at least 13 years old (or 16 years old if you reside in the European Economic Area) to use Pocus. By using the App, you represent that you meet the applicable age requirement. If you are under the required age, you may not use the App.
Pocus is built with a strict "local-first" privacy model:
Pocus offers premium features through an optional auto-renewing subscription called "Pocus+." By purchasing a subscription, you agree to the following:

A Pocus+ subscription unlocks the following features:
Feature availability may change over time. We will notify users of significant changes to premium features.
We offer a 7-day free trial for the Annual plan. During the trial, you may access all Pocus+ features at no charge. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription price.
Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.
Payment will be charged to your Apple ID account (App Store) or Google Play account at the confirmation of purchase. All payment processing is handled entirely by Apple or Google. We do not have access to your payment card details.
Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the original subscription price.
You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings:
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly:
You are solely responsible for the content you create and store within Pocus. You agree not to use the App for any unlawful purpose. Since all content is stored locally on your device and we do not host, monitor, or have access to your content, we cannot be held liable for any data you save.
Because all personal data is stored locally on your device, you are in full control of your data:

The App integrates with the following third-party services. Your use of the App is subject to their respective terms and privacy policies:
The App, including its design, code, graphics, mascot ("Poki"), animations, sounds, and all associated intellectual property, is owned by Kivrak Business LLC and is protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
You may not:
Content you create within the App (diary entries, photos, videos, recordings) remains your property.
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no warranties, express or implied, regarding the App's reliability, accuracy, availability, or fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Kivrak Business LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of or inability to use the App.
In no event shall our total liability exceed the amount you paid for the App or any subscription during the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Kivrak Business LLC from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or any violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, USA.
Notwithstanding the foregoing, nothing in this section limits your statutory rights under the consumer protection laws of your country of residence.
We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this document. For significant changes, we will provide a notice within the App.
Your continued use of Pocus after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you should discontinue using the App.
